Cancel a gym membership: notice periods, moving home and illness

How do I cancel my gym contract under the ordinary terms?

Check the date the contract was entered into, its minimum term and notice period. For contracts entered into on or after 1 March 2022, new limits apply to renewals under standard terms and conditions: after the initial term, renewal is generally only allowed for an indefinite period with a notice period of no more than one month. You cannot assume this rule applies to older contracts simply because they were renewed later. The legal basis is § 309 No. 9 BGB.

In your letter, identify the specific gym, your name, membership number and preferred or earliest possible end date. Save your notice and the gym's reply. The gym providers overview lists the providers held in SnapCancel's records.

Can I cancel immediately because I am moving home?

Moving home does not normally give you a statutory special right to cancel your gym contract. Instead, check whether your contract has terms covering a house move, a change of gym or a transfer of membership. You can also ask for a goodwill arrangement. Record any such agreement in writing, particularly the end date and any costs.

What applies if I am ill?

A long-term illness that prevents you from training may constitute good cause for cancellation. A temporary break from training is not automatically equivalent. The circumstances of the individual case and suitable evidence are what matter. The Verbraucherzentrale explains the distinction between moving home and illness.

Note when the restriction began and what information you have already received. Clarify which evidence is required before sending extensive medical documents. Send only the information needed for the assessment.

The gym has not confirmed my cancellation — what should I do?

Compare the recipient address and membership number with your documents. Refer to your original notice when asking whether it was received and what the end date is. If the date is disputed, ask for the calculation and contractual basis. A different response is a reason to check the details, not automatic proof that the gym is wrong.

Stopping a direct debit does not end the contract. If you cannot clarify whether your cancellation was received or is valid, get advice on the specific case before further costs arise.
