Missed a cancellation deadline? Check your contract renewal

Does missing a cancellation deadline mean another year on the contract?

Not necessarily. What matters is the type of contract, the date it was entered into and the valid renewal clause. Check these details before assuming you are committed for another year or can end the contract immediately. The renewal date alone does not answer the question.

For many consumer contracts for recurring services, § 309 No. 9 BGB limits the contract durations permitted in standard terms and conditions. The revised rules in force since March 2022 generally allow automatic renewal only for an indefinite period, with a notice period of no more than one month. The date the contract was entered into matters when deciding whether the rules apply to an older contract. The Verbraucherzentrale explains the rules on contract renewals.

Telecommunications contracts have their own rules: after automatic renewal following the minimum term, a notice period of one month applies. The Bundesnetzagentur explains this. This does not establish a general rule for all insurance, energy, rental or employment contracts.

How to work out your next step

1. Find your contract, contract summary and latest bill.
2. Note the date the contract was entered into, its minimum term and the notice period stated in the contract.
3. Check whether you are still in the initial term or the contract has already been renewed.
4. If the details are unclear, ask the provider for the earliest possible end date and the basis for it.
5. State clearly that you are cancelling and save the confirmation.

The wording "at the earliest possible date" can help if you cannot give a definite end date. It does not replace checking the date the provider gives you in its reply.

Is there another option?

Specific grounds for a special right to cancel can be assessed separately. Missing an ordinary cancellation deadline is not, on its own, such a ground. The right to withdraw from a contract is also not a general way out of a subscription that has been running for a long time. If you agree a goodwill arrangement, get confirmation of its scope and end date.
